IntekUSA Inc prides itself on customer satisfaction. Every transaction is important to us because IntekUSA wants to make you a customer for life. We want to encourage you to spread the great word-of-mouth advertising that is the lifeblood of our company. If you are dissatisfied with the quality of goods you purchase from us, or if you have not received the patient, respectful service you deserve, we want to know! Of course, we would also love to hear from you when you are one of our satisfied customers :-).

THE FOLLOWING AGREEMENT CONTAINS IMPORTANT INFORMATION CONCERNING YOUR RIGHTS AND OBLIGATIONS WITH REGARD TO PURCHASES FROM INTEKUSA INC.  PLEASE READ THIS DOCUMENT CAREFULLY. BY MAKING A PURCHASE FROM INTEKUSA, INC., YOU ARE AGREEING TO ABIDE BY THE TERMS OF THIS AGREEMENT.

Please note that purchases of electronic equipment, including computers, peripherals and software, are subject to restrictions imposed on us by manufacturers and governmental authorities that may be different from other purchases you make.

 

1. A WORD ABOUT WARRANTIES

Some of the products sold by IntekUSA Inc. are subject to a manufacturer's warranty. The warranty provided by the manufacturer is the first place to look for assistance with difficulties with your purchase. IntekUSA Inc. is prepared to help you obtain warranty service in the unlikely event you run into any difficulties. HOWEVER, WE DO NOT OFFER ANY SEPARATE OR ADDITIONAL WARRANTY OTHER THAN THE LIMITED, EXPRESS WARRANTY, IF ANY, OFFERED BY THE MANUFACTURER.

In the case of Seagate products, the manufacturer offers a 3-year warranty on all new equipment. During the warranty period, you may visit http://support.seagate.com/customer/warranty_validation.jsp to receive warranty or replacement service. Seagate's website contains many tools and troubleshooting options that you may be required to exhaust before an RMA is offered.

Warranties and warranty service from other vendors varies from manufacturer to manufacturer. Please contact a IntekUSA Inc. service representative with questions on applicable warranties before purchase. After purchase, you should contact the manufacturer first for the most expedient assistance with warranty issues, as they are best equipped to troubleshoot and resolve your warranty issues. If you encounter difficulties, please contact an IntekUSA Inc. service representative. We would be happy to assist with the resolution of any issues, BUT AGAIN, WE DO NOT OFFER ANY WARRANTY ON PRODUCTS SEPARATE OR IN ADDITION TO THE MANUFACTURER'S WARRANTY, IF ANY.
 

2. RETURN POLICIES AND PROCEDURES

 

NON-MANUFACTURER WARRANTY HARDWARE RETURNS

ONLY STORE CREDIT OR MERCHADISE EXCHANGE IS AVAILABLE ON HARDWARE RETURNS. UNUSUAL CUSTOM CONFIGURATIONS ARE SUBJECT TO SPECIAL RESTRICTIONS. MOST UNUSUAL CUSTOM CONFIGURATIONS MAY NOT BE RETURNED, SEE BELOW.  PLEASE CONTACT A SERVICE REPRESENTATIVE WITH ANY QUESTIONS ABOUT OUR RETURN POLICIES.
 

 
Dead on Arrival?
All merchandise purchased from IntekUSA.com that is defective upon receipt will be replaced free of additional charge within 90 days of receipt of goods.  In the case of DOA products, IntekUSA is usually willing to pay freight both ways, but reserves the right to require the customer to ship returned product pre-paid.
 

 

Just didn't like it?
Within 15 days of receipt of your purchase, if you are dissatisfied with your purchase for any reason, you may return your hardware purchase in its original packaging for a store credit or merchandise exchange in the amount of the THEN CURRENT PRICE FOR THAT PRODUCT or your original purchase price, whichever is lower, LESS shipping charges. Shipping charges to return the product are your responsibility. Refunds are also available with a 25% restock fee on most products.  Product must be unregistered with complete packaging and support material and ready for sale as a new product. Another shipping charge will be assessed against substituted merchandise.
 

 

Product is not working in your special configuration?
IntekUSA Inc. will make a good faith effort to replace your product with functional product.  IntekUSA Inc. reserves the right to replace or refund non-working products at its own discretion.  Refunds for non-defective products are subject to a 25% restock fee.
 

 

Shipping damages?
If you notice shipping damage upon delivery of goods to one or more of the boxes, please note the fact with the driver. Please contact sales@intekusa.com within 7 days of receipt of the damaged parcel. Once a claim has been made, IntekUSA will work with the carrier to have the damaged goods picked up.  IntekUSA Inc. reserves the right to refund or replace shipping damaged items.
 

 


REFUSED ORDERS


All refused orders will be subject to a 25% restocking fee. Shipping charges are not refundable. In addition, refused orders may be subject to additional shipping charges to cover the cost of returning the products to IntekUSA Inc.

International refusals are subject to taxes, import and export fees, as well as return shipping costs and the 25% restocking fee.


CUSTOM CONFIGURATIONS AND SPECIAL ORDERS


No returns or refunds will be made for items that are special ordered for you or for unusual custom configurations of systems without the written consent of IntekUSA Inc. in each instance prior to purchase. Please consult a IntekUSA Inc. service representative with questions.


RETURN PROCEDURE

Return merchandise cannot be accepted without a RETURN MERCHANDISE AUTHORIZATION. To obtain a RETURN MERCHANDISE AUTHORIZATION (RMA) please call IntekUSA Inc. at 760-728-3363 or e-mail sales@intekusa.com. IntekUSA Inc. will NOT accept returns without a Return Merchandise Authorization.

In order to obtain credit for any equipment purchase, you must return the equipment including all manuals, blank registration cards, accessories and packing materials, etc, in the original packaging. The equipment must not be damaged in any way. IntekUSA Inc. will NOT accept incomplete returns.

Returned goods must be shipped freight-prepaid and insured.

 

3. WARRANTY DISCLAIMER

Limited and express warranties made by manufacturers, if any, are included in the documentation accompanying product purchases. Graphics and other descriptions of products have been provided for your information only, and IntekUSA Inc.  makes no representation as to their accuracy or completeness. Colors and features may vary.
 
 

4. LIMITATION OF LIABILITY

IN NO EVENT SHALL INTEKUSA  INC. BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, IN DIRECT, EXEMPLARY OR PUNATIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST REVENUE OR PROFITS, LOSS OF BUSINESS OR LOSS OF BUSINESS OPPORTUNITY, WHETHER OR NOT INTEKUSA  HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. INTEKUSA'S LAIBLITY SHALL BE LIMITED TO REPAIR OR REPLACEMENT, IN THE SOLE DISCRETION OF INTEKUSA INC., OF ANY PRODUCT. CUSTOMER AGREES THAT IN NO EVENT SHALL LIABLITY OF INTEKUSA, INC.  EXCEED THE PURCHASE PRICE PAID BY CUSTOMER.
 

5. CHOICE OF LAW; CONSENT TO JURISDICTION; ATTORNEYS' FEES

Customer agrees that this Agreement shall be governed and interpreted in accordance with California law without regard to conflicts of laws rules. The parties agree that the state or federal courts of California of competent jurisdiction shall have exclusive jurisdiction to resolve any claim or action arising out of or in connection with customer's purchase from IntekUSA and this Agreement, and that all such actions shall be adjudicated in Murrieta, California. Customer consents to the personal jurisdiction of the courts of California for such purpose, and agrees it will not contest venue as appropriate in Murrieta, California. The parties waive right to trial by jury. IntekUSA Inc. shall be entitled to recover its reasonable attorneys' fees and costs of enforcement of this Agreement.
 

6. MISCELLANEOUS

Exclusive Agreement

This Agreement represents the entire agreement between customer and IntekUSA, Inc. with respect to its subject matter, subject only to the credit agreement, if any, between customer and IntekUSA, Inc. and the invoice descriptions of goods, pricing and quantity. These terms are subject to change by IntekUSA, Inc. at any time without prior notice. Terms of customer's purchase orders, offers or other terms and conditions are void and without effect. In the event that any provision of this Agreement is found unenforceable, the remaining provisions shall not be affected and shall continue in full force and effect. No failure by IntekUSA, Inc. to exercise any remedy for breach shall operate as a waiver of any other right or subsequent breach. Headings are for convenience only, and shall not affect the enforcement of any provision.

Export

Customer warrants that it is in compliance with all United States and state regulations governing receipt of computer equipment and software, and will comply with all United State regulations governing export and re-export of equipment and software, and is solely responsible therefore.

Prices and Quotes

Quotes are valid for the time period stated therein. IntekUSA, Inc. products and pricing are subject to change at any time without notice. IntekUSA, Inc. will attempt to procure any available product for you, but is not liable for changes in models or features or lack of availability of any particular product at any particular time.

IntekUSA, Inc. updates its site frequently, and every effort is made to provide and display up-to-date and accurate information. However, we reserve the right to cancel any order due to incorrect pricing or other terms displayed.. In this event, we will work with you to find the best available product in your price range, and issue an immediate credit to you on any pre-paid order.

Acceptance; Payment Terms; Shipment

Orders are not binding until accepted by IntekUSA, Inc.. Payment terms are in the sole discretion of IntekUSA, Inc.. Unless otherwise provided in any separate credit agreement between customer and IntekUSA, Inc., all orders must be prepaid by credit card, wire transfer or as otherwise provided on this site. Invoices are due and payable as provided therein. Parts of orders may be invoiced and shipped separately. Customer agrees to pay interest on any unpaid invoice in the amount of 1 1/2% per month, or the highest rate provided by law.

Shipment dates are approximate, and IntekUSA, Inc. shall not be liable for any delay in shipment. Shipping charges are noted on your invoice.

All sales are deemed made in California, regardless of customer's location.

Force Majeure

IntekUSA, Inc. will attempt to give you notice of any changes or delays to your order, but is not liable for damages resulting from delays beyond its reasonable control.
